1. Acceptance of Terms

By using Texas Taunt'em and its character creation features, you agree to be bound by this End User License Agreement. If you do not agree to these terms, do not use the character creation or generation features.

2. User Responsibilities

2.1 Content Creation

You are solely responsible for all content you create, including:

• Custom character names, descriptions, and personalities
• AI-generated characters requested through the generation system
• Any prompts or inputs provided to the AI system

2.2 Legal Compliance

You agree that you will not create or request content that:

• Infringes intellectual property rights (copyright, trademark, publicity rights, etc.)

  • Examples: Disney, Marvel, Lucasfilm, Warner Bros., DC Comics characters
  • Celebrity likenesses or personas without permission

• Violates applicable laws, including but not limited to:

  • Defamation or libel
  • Hate speech or harassment
  • Threats or incitement to violence
  • Illegal activities or content

• Contains inappropriate or harmful content:

  • Sexually explicit material
  • Graphic violence or gore
  • Content targeting or exploiting minors
  • Discrimination based on protected characteristics

• Violates platform terms of service

2.3 Public Domain and Original Content

You may only use:

• Public domain characters (e.g., Sherlock Holmes, Greek mythology figures)
• Your own original creations
• Generic character types (e.g., "a cunning pirate," "a wise wizard")

When in doubt, assume a character is protected and do not use it.

3. Examples

✅ Allowed

• "A space pilot mentor inspired by classic sci-fi"
• "Sherlock Holmes" (public domain)
• "Sir Aldric, a witty medieval knight"
• "Captain Red, a cunning pirate"

❌ Not Allowed

• "Obi-Wan Kenobi" or any Star Wars character
• "Elsa" or any Disney character
• "Spider-Man" or any Marvel/DC character
• "Elon Musk" or real public figures
• Characters promoting hate, violence, or illegal activities
• Sexually explicit or inappropriate characters

4. System Safeguards

Texas Taunt'em employs automated content filters and manual review processes to prevent inappropriate content creation. However, these safeguards are not foolproof, and users remain fully responsible for ensuring their own compliance with this EULA.

5. AI Service Disclaimer

Character generation uses third-party AI services (OpenAI). The AI provider:

• Is not responsible for user-generated content or outputs
• May generate unexpected or inappropriate responses despite safeguards
• Does not guarantee accuracy, appropriateness, or legal compliance of outputs

You use the AI generation feature at your own risk.

6. User Liability

You are responsible for:

• Ensuring your created content complies with this EULA and applicable laws
• Any claims or damages arising from content you intentionally create that violates third-party rights
• Your willful misconduct or gross negligence in using the character creation features

For EU Consumers: This section applies only to the extent permitted by mandatory consumer protection laws. You are not liable for:

• Unintentional errors or mistakes in content creation
• AI-generated outputs that you could not reasonably have prevented
• Technical failures or system errors beyond your control

7. Reporting and Enforcement

7.1 Reporting Violations

7.2 Enforcement Actions

Texas Taunt'em reserves the right to:

• Remove, restrict, or modify any content that violates this EULA
• Suspend or terminate accounts for violations
• Take legal action for serious or repeated violations
• Report illegal activities to relevant authorities

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• Texas Taunt'em provides character creation features "AS IS" without warranties of merchantability or fitness for a particular purpose
• We are not liable for user-generated content or its consequences
• We are not liable for AI-generated outputs, errors, or unexpected results
• Our liability shall be limited to the amount you paid for the service (if any) in the twelve months preceding the claim

For EU Consumers: Nothing in this section excludes or limits our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any other liability that cannot be excluded or limited under French or EU law

9. Updates to This EULA

We may update this EULA from time to time to reflect legal requirements, new features, or service changes. Material changes will be communicated through the app or by email.

For EU Consumers: You have the right to terminate this agreement if you do not accept the updated terms. Continued use after notification of changes constitutes acceptance.

10. Governing Law and Jurisdiction

10.1 Governing Law

This EULA is governed by the laws of France.

10.2 EU Consumer Rights

If you are a consumer in the European Union, nothing in this EULA affects your rights under applicable EU consumer protection laws, including:

• Directive 2011/83/EU on consumer rights
• Regulation (EU) 2016/679 (GDPR) on data protection
• Any mandatory consumer protection laws of your country of residence

10.3 Mandatory Local Laws

If you are a consumer and the mandatory consumer protection laws of your country of residence contain provisions that are more beneficial to you than this EULA, those provisions shall apply irrespective of this choice of law.

10.4 Jurisdiction

For EU consumers: Disputes may be brought before:

• The competent courts of your habitual residence, or
• The competent courts of France

For non-EU users: Disputes shall be subject to the exclusive jurisdiction of the courts of France.

10.5 Alternative Dispute Resolution

EU consumers may use the European Commission's Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr

We are committed to resolving disputes amicably and may participate in alternative dispute resolution procedures.

11. Data Protection

Your personal data is processed in accordance with our Privacy Policy and applicable data protection laws, including GDPR for EU users.

You have the right to:

• Access your personal data
• Rectify inaccurate data
• Request erasure of your data
• Object to processing
• Data portability
• Lodge a complaint with your national data protection authority
